Lamu Court has come to the rescue of Omar Lali, the boyfriend to the late Tecra Muigai after it declined to hold him for another week.
Omar Lali has been in custody for 21 days as the police have been investigating the cause of murder for the daughter of Keroche leaders, Tabitha and Joseph Karanja.
Through a video link, Lamu Principal Magistrate Allan Temba ruled the case where the DPP and the DCI were calling for the suspect to be held for another seven days as the investigations continue.
According to the DCI, Omar Lali was still needed to assist with the investigations by visiting areas allegedly believed to be of the crime scene including the Jaha house where Tecra fell causing her death.
However, according to the Principal Magistrate Temba, the suspect has so far been cooperative within the days as he has followed instructions by the law of assisting the investigations. Lali has been present in areas of the scenes.
“Lali has no capacity to interfere with witnesses as he doesn’t know who they are. The court will, therefore, fix the bond terms on Wednesday at 2.30 pm once Lali proves by documents his fixed abode,” said Mr. Temba.
The magistrate also stated that the DPP is yet to decide on which account Omar was held and which case he is to be charged with which they haven’t within the 21 days he has been in.
The court has called on the DCI to continue with the investigations with Omar not detained as the suspect does not pose to be a threat to the public nor a hindrance to the pending investigations.
Tecra was laid to rest on May 16th where the burial was attended by close friends and relatives. Omar was not in attendance.
